This privacy policy describes how Fastbreak AI and its affiliates (collectively, “Fastbreak,” “Swoop,” “Easy Event Tickets, ”“we,” “us,” or “our”) collect, use, share, and protect personal information on the app, website, or any other location where this policy is linked or posted, including offline collection (“Platform”).

This privacy policy also tells you about your rights and choices with respect to your personal information, and how you can reach us to get answers to your questions.

Information We Collect

We collect information about you in a variety of ways, depending on how you interact with us and our Platform, including:

Directly from you when you provide it to us, such as when you register for an account, complete a form, sign up to receive communications from us, or contact us by phone, email, or otherwise.
Automatically by cookies, server logs, and other similar technologies when you interact with our Platform, advertisements, or emails.
From other sources, including, for example, our affiliates, business partners, service providers, online social media networks, and other third parties, or from publicly available sources. For example, if you submit a job application, or become an employee, we may conduct a background check.

We have a legitimate interest in contacting and communicating with our clients or partners concerning normal business administration and operation such as projects, services, and billing.
Cookies and First-Party Tracking	We use cookies and clear GIFs. "Cookies" are small pieces of information that a website sends to a computer's hard drive while a website is viewed. For more information about the types of cookies we use and to update your preferences, click the “Your Privacy Choices” .	With your consent where required, we use cookies for a number of reasons, such as: to learn more about the way you interact with our content; help us improve your experience when visiting our Platform; to remember your preferences, such as a language or a region, so there is no need for you to customize the website on each visit; to identify errors and resolve them; to analyze how well our Platform is performing A limited number of cookies are placed when you visit our website regardless of your preference. These are necessary for website functionality, and we have a legitimate interest in making sure our site properly functions.
Cookies and Third-Party Tracking	We may place tracking technology on our Platform that collects analytics, records how you interact with our Platform, or allows us to participate in behavior-based advertising. This means that a third party uses technology (e.g., a cookie) to collect information about your use of our Platform so that they can report analytics to us or provide advertising about products and services tailored to your interests. That third party might also collect information over time and across different websites in order to serve advertisements on our Platform or other websites. Demographic Information	We collect certain demographic information, such as your date of birth, gender, and school, among other information that is about you.	We have a legitimate interest in determining your eligibility to register or use the Platform and to know more about how you will use the Platform.
Email Interconnectivity	If you receive email from us, we use certain tools to capture data related to when you open our message, or click on any links or banners it contains.	We have a legitimate interest in understanding how you interact with our communications to you.
Employment	If you apply for a job posting, or become an employee, we collect information necessary to process your application or to retain you as an employee. This may include, among other things, your resume and your Social Security Number. Providing this information is required for employment.	We have a legitimate interest in using information about current employees to perform our obligations to employees. In some contexts, we are also required by law to collect information about employees or applicants. We also have a legitimate interest in using your information to have efficient staffing and work force operations.
Financial Information	To the extent our Platform allows purchases, we collect information related to the purchases within the Platform, which include your credit card or bank account information.	We process transactions with our users on the Platform in order to perform our contract with those users.
Inquiries, Comments, and Feedback	If you contact us, we will collect your name and contact information, as well as any other content that you send to us, to reply.	When you contact us, you consent to receiving, and acting upon, your feedback or issues and following up on your comments, reviews, inquiries, and other requests.
Location Information	We collect information when you interact and use the Platform, including your location from GPS, Wi-Fi, and/or cellular technology in your device to determine your location.	We use this information to understand where you are accessing the Platform and to verify you live in a jurisdiction in which we offer services. In addition, this data helps us provide tailored services to certain geographic regions. We collect this information with your consent.
Mailing List	When you sign up for one of our mailing lists we collect your email address.	We share information about our Platform and services with individuals that consent to receive such information.
Photos, Videos, and Other Media	In some situations, you may be allowed to post or upload photos, videos or other media, some of which may contain biometric identifiers as noted above.	This information allows you to use certain aspects of the Platform and allows you to interact with other users, when you have access to do so. It is also used to identify individuals in photos on the Platform. When you upload photos to the Platform, you are consenting to our collection of this information.
Surveys	When you participate in a survey, we collect information that you provide through the survey. If the survey is issued by a third party, the third party's privacy policy applies to the collection, use, and disclosure of your information.	We use this information to understand your opinions and collect information relevant to us. To the extent the survey is provided by a third party, that third party decides the purpose of collection. You consent to our use of your information when you complete a survey.
Website Interactions and Logs	We use technology to monitor how you interact with our Platform. This may include which links you click on, or information that you type into our online forms. This may also include information about your device or browser, operating system, Internet Protocol (IP) address (a number that is automatically assigned to a computer when the internet is used), domain name, click-activity, referring website, and/or a date/time stamp for visitors.	Where required, we collect your consent for these technologies to understand how you interact with our website to better improve it, and to understand your preferences and interests in order to select offerings that you might find most useful. We also detect and prevent fraud with this information and have a legitimate interest to do so. We also monitor our networks and the visitors to our websites. Among other things, it helps us understand which of our services is the most popular. We base our collection of this information on your consent where required by law.

How We Use Information

In addition to the purposes and uses described above, we use information in the following ways:

To identify you when you visit our Platform.
To provide and improve the services and Platform we provide to you.
To communicate with you, such as to respond to and/or follow-up on your requests, inquiries, issues, or feedback.
To send marketing materials including information relating to our services, Platform, or promotions, or those of our business partners.
To detect and protect against malicious, deceptive, fraudulent, or illegal activity, including violations of our policies and terms and conditions, security incidents, and harm to the rights, property, or safety of our company and our users, employees, or others.
To debug, identify and repair errors that impair existing intended functionality of our Platform.

For internal administrative purposes, as well as to manage our relationships.
For such other purposes as you may consent (from time to time).

To the extent we maintain and use personal information in a deidentified form, we will not attempt to reidentify the information, except for the purpose of determining whether our deidentification processes satisfy our legal obligations.

Depending on the information collected, the categories of individuals within our organization who may access your personal information varies, such as our billing department, human resources, product management team, engineering, marketing and sales teams. For example, if you purchase a ticket from us, our billing department, ticketing support team, engineering team, and/or accounting team may view that information.

How We Share Information

In addition to the specific situations discussed elsewhere in this privacy policy, we may disclose personal information in the following situations.

Affiliates and Acquisitions. We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company, including at the negotiation stage.
Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies.
Public. Our Platform may provide the opportunity to post comments, or reviews, in a public forum. If you decide to submit information on these pages, that information will be publicly available.
Service Providers. We share your information with service providers. Among other things, service providers help us to administer our website and Platform, conduct surveys, provide technical support, and process payments.
Unaffiliated Third Parties. We may share your information with unaffiliated third parties, such as partners, marketing businesses, or other third-party entities, who may use the information provided for marketing, advertising, analytics, or other purposes as those parties deem acceptable.
Other Disclosures with Your Consent. We may disclose your information to other third parties when we have your consent or direction to do so.

Your Choices

Some jurisdictions give you the right to make the following choices regarding your personal information, and we honor those rights when required by law. Access To Your Personal Information. You may request access to your personal information or confirmation that we have information about you. In certain limited circumstances, you may also request to receive access to your data in a portable, machine-readable format. Some jurisdictions allow you to request a list of third parties to whom we have disclosed personal information to.
Changes To Your Personal Information. We rely on you to update and correct your personal information via the platform. You may ask us to correct information that is inaccurate or incomplete. Note that we may keep historical information in our backup files as permitted by law.
Deletion Of Your Personal Information. You may request that we delete your personal information. If required by law, we will grant a request to delete information, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purpose.
Objection to or Restriction of Certain Processing. In certain circumstances, you may object to the processing of your personal data, or request that that we restrict processing of your personal information.
Right to Limit Use or Disclosure of Sensitive Personal Information. We may use or disclose your sensitive personal information outside of the stated business purposes as allowed by applicable law. As a result, you may request that we limit the use or disclosure of sensitive personal information to only those purposes as allowed under applicable law. Opt-out of Targeted Advertising and Selling of Information. Where applicable, you may opt-out of online tracking-based targeted advertising (e.g., via applicable cookies) or the sale of information to third parties by clicking the "Do Not Sell or Share My Personal Information Link".
Please note that if you change browsers or computers, or if you clear your browser's cache, you may need to click the link again to apply your preference. We also recognize Global Privacy Control (GPC) signals enabled by customers on their web browser or web browser extension as valid opt-out requests where required by applicable law. Online Tracking. We do not currently recognize the"Do Not Track" signal.
Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us to send communications and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in emails that you receive. If you decide not to receive promotional emails, we may still send you service-related communications.
Promotional Text / SMS Messages. If you receive a text message from us that contains promotional information, you can opt-out of receiving future text messages by replying "STOP."
Revocation of Consent. Where we process your personal information based upon consent, you may revoke consent. Please note, if you revoke your consent for the processing of personal information, then we may no longer be able to provide you services.

Please note, not all of the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity. We will not discriminate against individuals who exercise their privacy rights under applicable law.

How We Protect and Retain Information

No method of transmission over the internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. If we are required by law to inform you of a breach to your personal information, we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Some aspects of our Platform permit you to create an account, and when you do, you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.

We retain your personal information for only as long as necessary to fulfil the purposes outlined in this privacy policy, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required or permitted by law. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we obtained the information, and whether we can achieve those purposes through other means, as well as applicable legal requirements.

Children

The Platform is not meant for anyone under the age of 13. If you are not at least 13 years old, then you must stop using the Platform immediately. If you are between 13 and 17 years old, then we may process some of your personal information with your consent as allowed under applicable law. We will do our best to inform you of the purposes and specific personal information to be collected at the time of collection and when we ask for your consent. Transmission of Information to Other Countries

Because of our multi-national presence, we transmit information between and among our affiliates and other third parties as discussed in this policy. As a result, your information may be processed in a foreign country where privacy laws may be less stringent than laws in your country or jurisdiction. Nonetheless, where possible, we take steps to treat your personal data using the same privacy principles that apply in your country or jurisdiction. By submitting your personal data to us, you agree to the transfer, storage, and processing of your information in a country other than your country of residence, including, but not limited to, the United States. Changes to This Privacy Policy

We may change our privacy policy and practices over time. To the extent that our policy changes in a material way, the policy that was in place at the time that you submitted personal information to us will generally govern that information unless we receive your consent to the new privacy policy. Your continued use of the Platform and services constitutes your consent to any changes we make to this privacy policy. Our privacy policy includes an “effective” and “last updated" date. The effective date refers to the date that the current version took effect. The last updated date refers to the date that the current version was last substantively modified. If we make a material change to our privacy notice, we will attempt to notify you.

California Shine the Light. If you would like more information concerning the categories of personal information (if any) we share with third parties or affiliates for those parties to use for direct marketing, please submit a written request to us using the information in the Contact Information section above.
California Sensitive Information Disclosure. We collect the following categories of sensitive personal information (as defined under California law): account log-in and password information, precise geolocation, certain financial information, government-issued identifications, as well as characteristics of a protected class, like age, sex, or race, and biometric information for the purpose of uniquely identifying a consumer. This information is collected to allow you to access and use the Platform, comply with laws, manage our business, provide you with services, and offer you employment, among other purposes.

Additional Information For Canadian Residents

Canadian residents imply consent to this privacy policy by continuing to use the website and otherwise engage in our services. Further, depending on the type of personal information collected, the means of collection, and our relationship to you, we may use implicit consent or explicit consent.
